今時ノーリードで散歩する方はいらっしゃらないですよね？

ですが、時にマナーなどを無視して非常識な方がいらっしゃり、大型犬などをノーリードで散歩しているのを見かける事があります。

近しいところでも、先日、友人のお母様と愛犬が散歩していて ノーリードで散歩していた犬に噛まれ大きなケガをしました！

これは、リードをしていなかった飼い主が１００%悪いです！

１、犬に噛まれた時の損害賠償や慰謝料はどうする？

 

今回、友人のお母様と愛犬が散歩中にノーリードで散歩していた犬に 噛みつかれて、愛犬は頭部に裂傷、お母様も手にケガをしました。

この事を聞いた時には自分の事のように怒りがわいてきて、 ケガして頭から血を流す愛犬の写真をみて怒りも頂点に！！

怖かったでしょうし、痛かったでしょうし・・・

 

加害者（噛んだ犬の飼い主）病院についてきて、その日の治療費も払い 慰謝料も支払いますと口頭で自ら申し出たらしいです。

しかし、これは、当然のことですよね！

 

愛犬だけではなく、お母様もお怪我されているので、

その分の治療費などをしっかりと請求しなければなりません

 

今回のようなケースでは、治療が完了してから怪我にかかった検査費、治療費、通院費、 治療のために仕事を休んだのであればその分の休業損害、 通院期間に応じた慰謝料を計算して書面で相手に示談請求（提案）をします。

これは、経費というか、当たり前の支払金ですよね！

 

相手が納得すれば示談書を交わして終わります。

しかし、ここで一番問題となるのは慰謝料です

 

診断書をもらって、警察などにも被害届をだし、 所謂、保険基準の場合、実通院日数×２×４２００円で計算しますが、 裁判基準の場合は、軽傷であった場合、半月通院で１０万円前後

１か月通院で２０万円前後くらいになります。 。。。

 

安いやろ～～～～～～～！

 

本当に、日本の慰謝料基準はどうなっているんだ？と疑いたくなります。 海外とかであれば、数千万の案件ですよね！！

その分、日本は他国に比べて安全ともいえますが、とにかく、 きっちり、可能な限り検査とかして治療費に関しては 漏れなく全部支払ってもらえば良いし、休業損害もしっかりと請求してください！

 

決して自分の持ちだしが発生しないように請求する！

一旦大丈夫だと思って、治療も終了したとたんに、後遺症が？！って事もあり得ます。

 

きちんと、後遺症が出た場合や、あとから痛みが発生した、もしくは、 PTSDなど心療内科に通わないといけないようになったなどの時の為に、 その時は、どうする？というのを明記しておいてください！

それでも納得いかない場合で、折り合いつかない場合は、 弁護士たてて多く慰謝料請求するしかないですね！

２、請求することでの考えられるリスクや注意するべきことは？

 

ここで、大切なことは、こちらにも非がある様に言われないように、 とにかく、自分で話しをする場合は、必ず書面でやりとりすることです！

言った言わないになりますと、ややこしくなりますし、長期化します。

ノーリードで散歩しているような非常識な方なので、 自分が思っていたよりも治療費などが高額になってきたとか、 慰謝料払えない、払う気が無くなったなどの時に、脅迫されたとか言われても困ります

 

実際に、昔、非のある加害者の方が、被害者にお金を払えと脅迫されていると、 警察署に被害届を出した事案がありました。

勿論、お巡りさんも事情調書した時点で、その加害者に対して 何だ？こいつ？！と内心思いながらも、届が出た以上捜査せざるを得ないのでと、 加害者にあきれながら対応してくださった事がありました。

 

中にはそのような非常識な人間もいますので、 こちらは、全く悪くはないのですが、請求の根拠を示して正当に支払わせる！

それが面倒であれば、弁護士さんなどのプロにお願いするのが安心です

３、まとめ

 

自分の常識が、赤の他人の常識じゃなく、寧ろ、非常識に思う様な人間も 結構世の中にはいるものです。

自分の常識で、この人は良い人そうだからと口約束で 補償の話しなどをしてしまいますと、履行されず、実行もされないまま 月日だけが経って行く様な事も怒ります。

他人とのトラブルが発生した場合には、口頭では無く、 約束事は、書面でかわす事！

面倒とか、書類を作れない方は、弁護士などのプロにお任せして、 脅されたなどと、逆に訴えられないように気を付けてくださいね！
